Terms and Conditions

Welcome!

 

Thank you so much for choosing 3D Digital Designs, we are so excited to be your design team. Here are a few things you can expect!

 

1. Quality! We pride ourselves on delivering you quality graphics and designs and we’re committed to delivering that to you in a timely and cost-effective fashion. 

 

2. Integrity! At 3D Digital Designs, integrity as one of our core values. We will honor our commitments, adhere to our policies, and most importantly, we won’t nickel and dime you or offer you services that you don’t need just to make a buck! 

 

3. Pride! We not only take pride in designing quality graphics, but we also take pride in how our designs are used. As a valued customer of 3D Digital Designs, we represent one another. Soooo, if a member of our team reaches out with suggestions on how to better market/advertise one of our designs, please don’t take it personal. We want our work to look good on you. 

 

 

We are committed to creating the best working relationship for our staff and clients. In order to ensure that we’re able to continue providing a superb customer experience we have outlined the terms and services of our agreement below. 

 

Here’s everything you need to know about refunds, turnaround times, the revision process, and more! We even removed all of the fluff, so that they are clear, cut and straightforward. 

 

The Process: Here’s what you can expect after your consultation. 

 

Your project will be assigned to a member of our design team once your payment has been received. 

 

They will begin working on your project using the information you provided during your consultation. In order to ensure that we properly manage our time, and so that no information is missed regarding your design, we will only communicate via email for the duration of your project, unless a follow up consultation is scheduled. You will receive the first proof of your design based on the turnaround times outlined in the service turnaround time section of this letter. After the first proof of the design is received if revisions are needed please reference the revision clause below for the appropriate turn around time. 

 

All revision requests must be submitted via email to: admin@3ddigitaldesignsllc.com. Please clearly outline any revisions that you would like made by writing the changes in numerical order, being as detailed as possible. In the revision section of this document, you will find additional information relating to our revision policy. 

 

Refund & Payment Policy: All payments are non-refundable and must be settled prior to the start of service. We gather all of your project details up front to minimize revisions, and so that our design team has all we need to deliver you a service you can be proud of. 

 

All services are non-transferable and must be retrieved within 14 days of purchase meaning the client is responsible for emailing all content needed to complete their project within 14 business days. If the client purchases a special/sale the client must send content within 90 days of the purchase. If the client fails to do so the purchase will be forfeited and their will be no refund. Please allow the appropriate turnaround time for your service. 

Communication

All formal communication after booking will be via email and not any other form of communication including social media. If a consult is needed it will be scheduled accordingly. If a client continuously addresses formal business via social media a formal warning will be grated. After three breaches of this policy the client's projected will be terminated. If the designer needs to contact a client and email communication is not adequate on behalf of the client 3D Digital Designs will do our best to reach you by the forms of contact provided. If there is still no response the project will be terminated after 5 business days of no response and no refund will be granted.  

 

Turnaround Times: 

 

Logos + Digital Graphic Design: 3-5 business days. Business days are Monday thru Friday.

 

Graphic Design + Print Services: 7-10 business days. Business days are Monday thru Friday.

 

Hashtag Sign: 7-10 business days. Business days are Monday thru Friday.

 

Shipping: Domestic standard shipping is 2-3 business days and Overnight shipping is 1 business day. This is calculated from the time the product or service has finished printing.  Business days are Monday thru Friday.

 

Website Design: 14-20 business days. Business days are Monday thru Friday.

 

Book Cover Design: 10-14 business days.  Business days are Monday thru Friday 

 

Turn arounds on large pages and branding suites vary based upon the package. 

 

Rush Fee: Must be requested at time of booking for an additional rate that will be quoted based on the service requested. 1-2 business day turnaround for services that include a rush fee. Business days are Monday thru Friday.

 

Revisions: There are a maximum of 2 revisions included for each project. Once a revision is submitted, there is a 2-3 business day turnaround time for you to receive your updated graphic design, 7-10 business days for website revisions and a 3-5 business day turnaround on logo designs, book covers and branding suites. All revisions must be submitted via email and your email must contain all of the changes that you would like to see made in one message, otherwise it will be viewed as multiple revision requests. Please be thorough in explaining the updates you would like us to make and include the changes in numerical order in your communication to our team. 

 

You will be charged an additional fee for all revisions made in excess of the 2 that are included with your service.

WEB DESIGN SERVICES
3D Digital Designs will design the initial proof of your website within 20-30 business days after your purchase is made and the website content is sent. This time frame does not include revisions. The time frame for revisions are addressed below in the section entitled Delivery.  The above client is responsible for organizing a submitting all content needed to complete  the website design within 14 business days. Failure to do the above may result in the termination of the project with no refund grated neither will the payment be allowed to be transferred to another service. 

3D Digital Designs will not create the content needed to fulfill the project at hand. We are only responsible for the design of your website. 3D Digital Designs will not accept links with images. All images and mp4 files must be attached to one email thread directly if there is an issue with the size delivery please minimize the number of emails to the best of your ability. 

If a client is building a an online store on their website up to 5 product uploads with 2 customized variants per product is included in the website design purchase .  Additional Product Uploads will be $10 per product with 2 customized variants each. Addition customized variants exceeding 2 per product will be $2 each per customized variant. 

2. Upon submission of your content all details sent are final. If changes to the information, images or videos are needed it may result in additional cost.  

3. FEES AND EXPENSES
An invoice will be sent to the above business entity and the above business entity will be responsible for making the website design purchase in full. If the client chooses the option of a deposit of half the client must pay the balance within 20 business days of the initial deposit. 

3. TERM AND TERMINATION
This Agreement shall last from the date of execution to the completion of the Services, as described above. If an extension is needed on the project from the designer the designer will request an extension from the client via email. If the client fails to submit their content within 14 business days or make their purchase in full as described above the attached agreement and project will be terminated. 

 

4. DELIVERY
​Once the proof of the client's website design is complete the client will be sent a link for review. If revisions are needed the client are responsible for listing all revisions in numerical order via email. The time Frame for revisions may vary depending upon how extensive they are.  

5. Once we have completed your website we sill transfer it to you via email. You are responsible for accepting the transfer within 48 business hours. 3D Digital Designs then mark your project FINAL. After finalization if you choose to hire 3D Digital Designs to revise your website in any way additional fees may apply, 

 

Quotes: 

Quotes are valid 15 business days from the date issued. Business days are Monday thru Friday.

 

Design Finalizing: After a design is finalized, additional changes cannot be made to the design. Please review the revision policy for further clarity. If the request does not qualify as a revision, then it is a new design which requires a new quote, invoice and associated fees.

 

No Response: No response on a design draft within 5 business days will result in a forced finalization. This means that your design will be finalized without your final approval. Revision requests received after a forced finalization and you will have to make the purchase again to re-open your project. 

 

Courtesy Clause: During your design process it is vital for you to understand that we are actively working to fulfill your vision and produce a quality product. We ask for the courtesy of allowing us to do so. You will receive your project on or before the turn around date depicted in the terms and conditions. If trying to contact a member of our design team, please email admin@3ddigitaldesignsllc.com  Please allow 72 hours, excluding weekends and holidays for a member of our team to respond to emails not directly related to your existing projects revision.  

 

Errors or Omissions: The Client has the responsibility to proofread and examine all work produced during the project. Therefore, the Client is ultimately responsible for any typographical, spelling, grammatical, copy, photographic, illustrative, layout or other errors, omissions discovered after printing or reproduction, for any work or services performed by any party selected by the Client. 

 

Ownership and Usage: The Designer assigns all rights of the approved project to the Client upon full payment for the project/s. 

 

My Rights As The Designer:

As the designer we reserve the right to share your project at any stage in the design process with our marketing audience for the purposes of 3D Digital Design LLC promotional content. In the event that 3D Digital Designs chooses to use discretion and not reveal our client's identity while promoting the design aspects of your project all identifying aspects of you and your company will removed and the design only will be promoted. 

 

As the designer I have the right to refuse services if a client or project does not meet the qualifications of the terms and conditions. 

 

Dispute Resolution: All disputes related to this Contract shall be resolved exclusively in a court located in Macomb County, Michigan and shall be governed by Michigan law. Each party irrevocably waives its right to a jury in any such dispute. The non-prevailing party shall be responsible for the prevailing party’s attorneys’ fees and any other costs related to resolving the dispute. The prevailing party shall be entitled to recover all costs, expenses, and reasonable attorney’s fees in any action brought to enforce the terms of this Contract.
